To access certain features of the Service, you must create an account using Google OAuth authentication. You agree to:

Accept responsibility for all activities that occur under your account
We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our sole discretion.
4. Credit System & Payments
Credit-Based System: The Service operates on a credit-based system. Credits are required to generate media content and are consumed based on the type and duration of content generated.
Purchasing Credits: Credits may be purchased through our payment processor, Stripe. All prices are displayed in US dollars and are subject to change with notice.
No Refunds: ALL CREDIT PURCHASES ARE FINAL AND NON-REFUNDABLE. Once credits are purchased, they cannot be refunded, exchanged, or transferred. Please review your purchase carefully before completing any transaction.
Credit Expiration: Purchased credits do not expire and remain in your account until used.
Chargebacks: If you initiate a chargeback or dispute a legitimate charge, we reserve the right to immediately suspend your account and pursue collection of any amounts owed.
5. User Content & Ownership
Your Content: You retain all ownership rights to content you upload to the Service ("Input Content") and to AI-generated content created through your use of the Service ("Output Content").
License to Us: By uploading Input Content, you grant us a limited, non-exclusive, royalty-free license to process, store, and transmit your content solely for the purpose of providing the Service to you.
Your Responsibilities: You are solely responsible for:
Ensuring you have all necessary rights to Input Content
The legality and appropriateness of all content you create
Any claims arising from your use of Output Content
No Guarantee: We do not guarantee the uniqueness, quality, or suitability of any Output Content for any particular purpose.
6. Acceptable Use
You agree to comply with our Acceptable Use Policy, which is incorporated into these Terms by reference.
In general, you may not use the Service to:
Generate NSFW, pornographic, or sexually explicit content
Create content depicting violence, gore, or harm to individuals
Produce content that infringes on intellectual property rights
Generate content promoting hate, discrimination, or harassment
Create deepfakes or misleading content depicting real individuals without consent
Violate any applicable laws or regulations
Violation of the Acceptable Use Policy may result in immediate account termination without refund.
7. Intellectual Property
Our Property: The Service, including its original content, features, and functionality (excluding User Content), is owned by Synthetik Media LLC and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
Trademarks: "Synthetik Media" and our logo are trademarks of Synthetik Media LLC. You may not use our trademarks without prior written consent.
DMCA: We respect intellectual property rights and respond to notices of alleged infringement in accordance with the Digital Millennium Copyright Act (DMCA). See our Acceptable Use Policy for our DMCA procedure.
8. Third-Party Services
The Service integrates with and relies upon third-party services, including but not limited to:
Google (authentication)
Stripe (payment processing)
Various AI model providers (content generation)
Cloud storage and CDN providers (media storage and delivery)
Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the actions or policies of third-party services.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

The Service will be uninterrupted, secure, or error-free
The results obtained from the Service will be accurate or reliable
The quality of any content generated will meet your expectations
Any errors in the Service will be corrected
No Uptime Guarantee: We do not guarantee any specific level of availability or uptime for the Service.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SYNTHETIK MEDIA LLC, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
Your access to or use of (or inability to access or use) the Service
Any conduct or content of any third party on the Service
Any content obtained from the Service
Unauthorized access, use, or alteration of your transmissions or content
Maximum Liability: Our total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
11. Indemnification
You agree to defend, indemnify, and hold harmless Synthetik Media LLC and its officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service, including but not limited to your User Content, any use of the Service's content other than as expressly authorized in these Terms, or your violation of any third-party rights.
12. Termination
By You: You may terminate your account at any time by contacting us at support@synthetikmedia.ai. Upon termination, your right to use the Service will immediately cease.
By Us: We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.
Effect of Termination: Upon termination:
All rights granted to you under these Terms will immediately cease
Any unused credits will be forfeited without refund
We may delete your account data in accordance with our Privacy Policy
Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
13. Dispute Resolution
Binding Arbitration: Any dispute, controversy, or claim arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by arbitration in Wyoming before a single arbitrator.
Arbitration Rules: The arbitration shall be administered by JAMS pursuant to its Comprehensive Arbitration Rules and Procedures. Judgment on the award may be entered in any court having jurisdiction.
Class Action Waiver: YOU AGREE THAT ANY ARBITRATION OR PROCEEDING SHALL BE LIMITED TO THE DISPUTE BETWEEN US AND YOU INDIVIDUALLY. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
Informal Resolution: Before initiating arbitration, you agree to first contact us at support@synthetikmedia.ai and attempt to resolve the dispute informally for at least 30 days.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
15. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect by posting the updated Terms on this page and updating the "Last updated" date.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
